Guests under 18 years of age must be accompanied by a parent or legal guardian at time of check in. Guests within the ages of 13-15 must be accompanied by a parent or legal guardian at all times while using the facility. All guests under the age of 18 must have a parent/legal guardian sign a liability release in club. Must show valid photo ID. Other restrictions may apply. Guests are unable to use tanning. Because physical exercise can be strenuous and subject to risk, the club urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity.

LIABILITY WAIVER

I agree that if I engage in any physical exercise or activity, or use any club amenity on the premises or off premises at a sponsored club event, I do so entirely at my own risk. This includes, without limitation, my use of the locker room, parking area, sidewalk area, or any equipment in the premises, and I assume all risks of injury, illness, damage or loss or theft of any personal property. I also agree to abide by all club rules and regulations.

IN CONSIDERATION OF HAVING ACCESS TO CHUZE FITNESS’ PREMISES, SERVICES, EQUIPMENT, FACILITY AND AMENITIES, I (on behalf of myself, my spouse, children, heirs, personal representatives, executors and assigns and anyone claiming by or through any of the foregoing) HEREBY RELEASE, FOREVER DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS CHUZE FITNESS (and all dba’s, Rachas Inc. and it’s parent companies, limited partners, franchises, including all affiliates, owners, directors, officers, employees, agents, successors and assigns – collectively as “CHUZE FITNESS”) FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION, INCLUDING, WITHOUT LIMITATION, CLAIMS FOR PERSONAL, BODILY, OR MENTAL INJURY, INJURY DUE TO CONTAGIOUS DISEASES, INCLUDING BUT NOT LIMITED TO COVID-19, ECONOMIC LOSS OR ANY DAMAGE TO ME, MY SPOUSE, GUESTS, UNBORN CHILD, OR RELATIVES RESULTING FROM THE NEGLIGENCE OF CHUZE FITNESS OR ANYONE ON CHUZE FITNESS’ BEHALF OR ANYONE ON THEIR PREMISES, WHETHER RELATED TO EXERCISE OR NOT.

I have carefully read this waiver and release and fully understand that it is a release of liability. I agree to voluntarily give up any right that I may otherwise have to bring a legal action against the club for negligence, or any other personal injury or property damage or loss action.

GUEST INDEMNIFICATION

I understand that as a MORE Member, I have the benefit of bringing guests onto the premises to use the equipment and facilities, excluding HydroTherapy and Tanning. I agree than I am responsible for making sure any guest I bring to the premises is aware of, and understands, all rules and policies of the club. In consideration for the benefit of bringing guests to the club, I agree to I further agree to indemnify and hold harmless CHUZE FITNESS (and all dba’s, Rachas Inc. and it’s parent companies, limited partners, franchises, including all affiliates, owners, directors, officers, employees, agents, successors and assigns – collectively as “CHUZE FITNESS”) from any and all claims, demands, or causes of action which are brought by, or on behalf of my guests, and which are in any way connected with such use by them, including but not limit to claims for personal, bodily, or mental injury, or economic loss resulting from the negligence of CHUZE FITNESS or anyone on CHUZE FITNESS’ behalf or anyone on their premises, whether related to exercise or not.
